Smart – Terms of Service

Welcome to Smart

These Terms of Service ("Terms") govern your access to and use of Smart's products and services (the "Service"). By using Smart, you agree to these Terms.

1. The Service

AI-Assisted Analytics

Smart provides an AI-assisted analytics service that enables users to analyze data from connected sources, including databases and spreadsheets, using natural language.

Service Operations

To operate the Service, Smart may:

Smart processes data in memory only and does not permanently store customer query data or results.

  • Access and map database schemas or file structures
  • Process schema metadata and limited data samples (≤10 rows per column) solely for query disambiguation
  • Generate analytical outputs such as tables, charts, and SQL queries

2. Data Ownership & Processing

Your Data

You retain full ownership of all data you upload or connect to Smart.

Data Use

Smart processes data only to provide the Service, in accordance with the principles described in our Security & Trust Center.

No Persistent Storage

Smart does not store customer databases, spreadsheet contents, or query results beyond what is required to operate the Service.

Model Training

Customer data is not used to train foundation models unless explicitly agreed in writing.

3. Transparency & User Responsibility

Smart is designed to support auditability and verification.

Auditability Features

Users may view generated SQL queries and underlying logic where applicable.

You are responsible for:

  • Ensuring the accuracy and appropriateness of your data
  • Reviewing outputs before using them for business or operational decisions
  • Verifying results using the provided SQL visibility and reasoning traceability

Smart provides analytical assistance, not professional, financial, or legal advice.

4. Security & Deployment

Industry-Standard Security

Smart follows industry-standard security practices, including:

Customers are responsible for selecting deployment regions that meet their regulatory obligations.

  • Encrypted data transmission (TLS)
  • Isolated customer environments
  • Regional deployment options (e.g., EU for GDPR) upon request

5. Beta & Early Access

The Service may be provided as part of a private beta or early access program.

Accordingly:

• Features may change, evolve, or be removed

• The Service may contain errors or interruptions

• The Service is not guaranteed for production-critical use

Feedback may be used to improve the Service.

6. Intellectual Property

Smart retains all rights to the Service, including its software, models, logic, and interfaces.

These Terms grant you a limited right to use the Service and do not transfer ownership of Smart's technology.

7. Limitation of Liability

The Service is provided "as is" and "as available."

To the maximum extent permitted by law:

• Smart makes no warranties regarding accuracy, completeness, or fitness for a particular purpose

• Smart is not liable for decisions made based on outputs generated by the Service

• Smart's total liability is limited to the fees paid to Smart in the preceding twelve (12) months, or zero if the Service is used under a free tier

8. Termination

You may stop using the Service at any time.

Upon termination, Smart revokes access to connected data sources.

9. Governing Law

These Terms are governed by the laws of Estonia, without regard to conflict-of-law principles.
